Lawsuit against Federal Bureau of Prisons Denied (1997)

The suit against the Bureau of Prisons (BOP), which is based on the violations of the first, fifth and eighth amendment has been bitterly fought in the US Court of Appeals in the District of Columbia Circuit. Our legal team of Deirdre Davis and Roger Wareham, Attorneys-at-law; Watani Tyehimba, private investigator and paralegal; and myself contested every effort on the part of the government’s attorney representing the BOP to undermine our legal team by painting me as a terrorist. Their theory, which proved to be successful, was to put my political view as a basis for the unconstitutional behavior in my transfer and isolation in the most maximum-security prison in this country. Their claims were that the reasons for the transfer were administrative, based on security reasons. We have pointed out, with evidence derived from the BOP secret files, (procured by Attorney Jonathan Lubell under Freedom of Information Act litigation) that without doubt or contradiction clearly state that their objective was to isolate me. This is verified by the following quotes:

In a March 4, 1994 – Memorandum for SIS Officer A. Aponte at Lewisburg to central file and office – in support of a transfer of Mutulu Shakur to Marion.

“Shakur in his cause and belief has made unauthorized contact with the news media in order to have a personal interview. He has also enlisted the service of three attorneys to pressure the media in conducting the interview.”

Another memorandum pursuing the same objective (that being my isolation at Marion and Florence, ADX).

“I firmly believe Shakur needs the control of Marion, as he appears to manipulate the entire system. This sharude (shrewd?) behavior coupled with his outside contacts and influence over the younger Black element will have adverse effect on the mission.”

In the face of this evidence clearly there can be no doubt that there exists a ‘genuine issue in dispute’, which is all that is required in prevailing law to allow the civil legal process, the suit to continue its natural course.

The District Court as well as the US Court of Appeals for the District of Columbia has drawn a line in the sand, choosing not to allow these violations to be brought out into the open courtroom with a jury. They fear the truth, which will not support the overall objective of denying the existence of PP’s and POWs as we continue our efforts to bring dignity to an undignified attempt to dehumanize us in particular and the disproportionate amount of oppressed nations inside of American prisons.

Our team believes the fight was and is important. We believe strongly that it should be fought, and we will exhaust all domestic legal remedies up to the Supreme Court. Thank you all for your support on this issue. It is a just fight to uncover the legalization of 21st Century slavery.

Statement to the Committee to End the Marion Lockdown

The manifestation of control units in America, ushers in the existence of apartheid for the 21st century secure in the rubric of a conspiracy disguised as constitutionally legal in confronting crimes. The real question is does it reflect human fights violations?

In actuality the political and social containment of growing discontent, and the resistance against the trend of racism and economic oppression are the motives, which are disguised by double speak through Madison Avenue promotional mix for the Government and its agents. Wall Street s marketing strategy for investment in the privatization of prisons and related industries coupled with prolification of state and government prisons all over the United States and its colonies securing continued labor forces, using the strategy with NAFTA Agreement, insures a protracted struggle for human rights protection against human rights violations. Clearly the rush to pass the New Crime Bills death penalties were not aimed at the protection of the citizen or victims of crime but rather, by their nature, the 60 new death penalties under federal statue are aimed at the protection of the state and their anticipation of resistance.

The role of control units to contain the most political aware, as well as the political prisoner and prisoner of war of National Liberation Movement And the seasons veteran against prison repression serves as a reminder of the true intent, which accounts for the vast amount of time given for nonviolent offenses, with no anticipation of release. These conditions provide a vehicle to raise the level of public conscience. The major question we must address is, will we he able to present these circumstances against this force, which would shock the conscience of the masses, guiding them to respond effectively and decisively.

The task facing CEML, which historically has attacked the control unit of Marion at the onset of its tactical use in 1983, with the federal prisoner system remains, to continue its work by effectively presenting the correct analysis and work. Support for CEML and the National Campaign t stop control units provide a very important vehicle to raise their level of struggle The battle to expose prisons and the interrelationship to racism and crime, is an old on but now there exists new tactics and strategies. The reemergence of chain gangs in various states, the legally justified acts of brutality as well as physical physiological in the many gulags in America must be confronted on all levels.

The work by members of the New Afrikan Liberation Front is well as Sister Tanaquil and Brother Dhoruba. The Pelican Bay Committee, of California. These forces are maintaining the umbilical relationship between those of us inside with the Free World humanizing the prisoners in the faces of demonization. The question of fighting crime in the community in America is a real issue that must not be side stepped or evaded. The root course for crime today, must be a mass based community control solution in order, to effectuate real results as well as its essentialness to self determination and liberation. To allow conditions which predispose people to crime and the results there of, by evading our responsibility which will allow the implementation of fascist racist and abusive of power, creating conditions of totalitarianism is a grave mistake, we must not be fooled.

The battle to stop control units will become a very important endeavor in the ensuing struggle in the 21st century. Hopefully, it will enlist an element which has not as of yet been motivated. As a prisoner of war that has been in two control units, I am encouraged by your work and presence. The struggle will be intense.

The Use of Acupuncture by Revolutionaries: An Interview with Brother Tyehimba

On the History of the Use of Acupuncture by Revolutionary Health Workers to Treat Drug Addiction, and US Government Attacks Under the Cover of the Counter-Intelligence Program (COINTELPRO): A Telephone Interview from Lompoc Federal Prison with Tyehimba Jess of WHBK Radio in Chicago (October 1992)

Announcer: But, it seems like things have straightened themselves out right about now. We are on. . .we have on the line with us a Brother, Mutulu Shakur, from the. . .who is currently being held in Lompoc Prison.

Let me tell you something about Brother Mutulu Shakur. Brother Mutulu Shakur is a doctor of acupuncture. As an acupuncturist and healthcare worker, Brother Shakur worked from 1971 to ’78 for the Lincoln Hospital Detoxification Program in the Bronx in New York. Then, from 1978 to 1982 Dr. Shakur was the co-founder and co-director of the Black Acupuncture Advisory Association of North America, also known as BAAANA and the Harlem Institute of Acupuncture.

At the Lincoln Detox Center, Dr. Shakur lead a program which used acupuncture to assist in the detoxification of thousands of drug addicts. The Lincoln Detox program was recognized as the largest and most effective of its kind by the National Institute of Drug Abuse, the National Acupuncture Research Society and the World Academic Society of Acupuncture.

Further, at BAAANA, Dr. Shakur continued his remarkable work against drug addiction. He also treated and/or supervised the treatment of thousands of elderly and poor patients who otherwise would have received no treatment of this kind. Patients were able to receive quality healthcare at reasonable prices. Moreover, the clinic at BAAANA served on a regular basis many community leaders, political activists, lawyers, doctors and various international dignitaries. At BAAANA, Dr. Shakur and his co-founder, Dr. Richard Delaney, trained over 100 students in the medical sciences of acupuncture. Some of the trainees at the Harlem Institute of Acupuncture were already medical doctors licensed by various states in the United States.

Also in the late 1970s, just to tell you a little bit about this brother’s proficiency in his field, Dr. Shakur traveled with Dr. Mario Wexu, Director of Education at the International Association of Traditional Chinese Acupuncture in Montreal to the People’s Republic of China, where he observed and studied acupuncture applied as the primary form of medical care. We are not just talking about someone who, you know, dibbles and dabbles in his field, but he does some serious research, know what I’m saying.

Brother Shakur also worked with the Revolutionary Action Movement, RAM, in his early years. This was a revolutionary Black Nationalist organization which struggled for black self-determination and socialist change in America. Brother Dr. Shakur has furthermore been a dedicated worker and champion in the struggle against political imprisonment and political convictions of black activists in America.

He has also been a leader in the struggle against illegal United States and local American law enforcement programs designed to destroy the black movement in America and has worked to expose and stop the secret American war against its black colony. Brother Shakur served on the committee to defend Herman Ferguson, a leading black political activist and educator charged with conspiracy in the RAM conspiracy case of the 1960s. Dr. Shakur was a member of the National Committee to Free Political Prisoners. He has worked to legally defend and support political prisoners and prisoners of war like Imari Obadele, Ph.D. and the RNA-11, Reverend Ben Chavis and the Wilmington 10, Geronimo Pratt of the Black Panther Party, Assata Shakur of the Black Liberation Army, Sundiata Acoli also of the Black Liberation Army.

He contributed to the development of a petition to the United Nations by the National Conference of Black Lawyers and others. As a matter of fact, that petition is now documented in the book “Illusions of Justice” by Lennox Hinds. He used to also work with the National Conference of Black Lawyers on developing defense committees for numerous political prisoners and prisoners of war.

In addition, and I’m running out of breath with this Brother’s accomplishments, Brother Shakur was most importantly a co-founder and director of the National Task Force for COINTELPRO Litigation and Research which investigated, exposed and instigated suits against the FBI and other American law agencies for criminal acts, domestic spying, dirty tricks, repression, and low intensity warfare maneuvers against the New African independence struggle and others struggling against oppression in America.

Now, having given you this amazing biography, one thing I do have to say before I begin this program is that everything you hear on this show is not necessarily, you may be surprised to know, not necessarily the opinion of the University of Chicago or the University of Chicago’s Board of Trustees. But having said that I would like to bring on the air Brother Shakur. Brother Shakur are you with us?

Code of THUG LIFE

ThugLifeCover430In 1992, at a cease fire agreement and gang ‘Truce Barbecue’ in Watts, California, Tupac Amaru Shakur was instrumental in getting rival members of the Crips and Bloods to sign a code of ethics, that which is called The Code of Thug Life. He and Dr. Mutulu Shakur had helped write up The ‘Code,’ with other ‘O.G’s’ who came together to bring order to the violence on the street.

Introduction:

Someone must dare put the street life back on track, because it is clear to anybody that can see – that the hustling game has gone stark raving mad.

The short and long range result, will not only be detrimental to the street game, but more importantly, the combination of the self destruction & turf warfare, coupled with the government’s police terrorism, fascist laws designed to capture and keep our Black men and women in prison for the rest of their lives, leaves a defenseless Black community – which will result in our genocide.

For as long as the street game / hustle has existed in our community, which is the result of many factors (and will only be resolved through our liberation), it has been viewed as a necessary tolerance between the legal and illegal economy and culture.

The underground economy has, in many areas, been supportive of the uplifting of the Black community. Although, for a fact, it has been the downfall of individuals, the dynamics of struggle between the do-gooders and the thugs has kept a consistent battle for balance in The Black Community which at least was under our control.

The rules of engagement of the hustle was a code of the thug life. This code was the A, B, C’s of how the street game should and would be played. These rules allowed for money to be made by the crews in the different fields of the game, and determined how disputes between and among the players should be handled.

It also allowed the people who were not in the game to pressure the enemy of our people, and allowed the people who would work in the interest of our people (education, health, housing, legal, etc.) to feel that the effort was worth it.

The game today, as it exists, is a complete violation of the code. Historically, the street hustler was hip to the enemy and would never work in the government’s interest to destroy their own people.

The thug life is a tool of the enemy as it exists today; it must change. The interests of outside forces are being served by the hustlers, because the crew has no dignity or honor – and this must be corrected. A council must be called to put a code to the thug life.

We accept that the game will go on until our liberation. What we won’t accept is that the game will destroy us from within before we get another chance to rumble and rebuild. We will not allow ourselves to be played by the covert operations, COINTELPRO, and low intensity warfare waged by the United States government.

A code must be established. As we look at the West coast, the majority of the life is controlled by gangs (Latin/Chican and of the Black community as well). The gangs are the force behind the underground economy in our hoods.

In the mid-East, the common denominator there is also the gangs, which are responsible for the street life. Politically, culturally, and economically, these forces attempt to put the game back on track and work in the interests of the community and to resist the strategy of the government. They have begun setting down a platform for the street game in full effect – we praise this effort.

The code of the thug life must become a part of East coast street life as well. There must be a common denominator.

The original gangsters behind the walls of the dungeon will take some responsibility to putting force to the council and the code.

We must act now. The Code of the Thug Life will save us to fight another day. If we don’t, then we will lose…

While other forces attempt to bring peace and unity to the gangs and crews of the street life…Although we re down with that, and shout out to those attempts, we have always tried to be real with the people. Some folks may oppose what we say and do.

What we’re putting out here is a code to the true dwellers in the thug life. We don’t see this as an end of the game, or the street game as a real end. What we need is liberation. But what we do see if the bringing of some honor to being true to the life – and being real to our family which is a giant step to being down with the true thug life.

Code of THUG LIFE:

  1. All new Jacks to the game must know: a) He’s going to get rich. b) He’s going to jail. c) He’s going to die.
  2. Crew Leaders: You are responsible for legal/financial payment commitments to crew members; your word must be your bond.
  3. One crew’s rat is every crew’s rat. Rats are now like a disease; sooner or later we all get it; and they should too.
  4. Crew leader and posse should select a diplomat, and should work ways to settle disputes. In unity, there is strength!
  5. Car jacking in our Hood is against the Code.
  6. Slinging to children is against the Code.
  7. Having children slinging is against the Code.
  8. No slinging in schools.
  9. Since the rat Nicky Barnes opened his mouth; ratting has become accepted by some. We’re not having it.
  10. Snitches is outta here.
  11. The Boys in Blue don’t run nothing; we do. Control the hood, and make it safe for squares.
  12. No slinging to pregnant Sisters. That’s baby killing; that’s genocide!
  13. Know your target, who’s the real enemy.
  14. Civilians are not a target and should be spared.
  15. Harm to children will not be forgiven.
  16. Attacking someone’s home where their family is known to reside, must be altered or checked.
  17. Senseless brutality and rape must stop.
  18. Our old folks must not be abused.
  19. Respect our Sisters. Respect our Brothers.
  20. Sisters in the Life must be respected if they respect themselves.
  21. Military disputes concerning business areas within the community must be handled professionally and not on the block.
  22. No shooting at parties.
  23. Concerts and parties are neutral territories; no shooting!
  24. Know the Code; it’s for everyone.
  25. Be a real ruff neck. Be down with the code of the Thug Life.
  26. Protect yourself at all times.

Open Letter from the Students of BAANA

We are the students of the acupuncture and natural healing school of the Black Acupuncture Association of North America (B.A.A.N.A.), a newly formed association of Black and Puerto Rican acupuncturists that grew out of the struggles of the People’s Program, Lincoln Detox Acupuncture Research Unit’s clinic and school.

Lincoln Detox, a community controlled program of drug detoxification, operated for nine years in Lincoln Hospital, Bronx, New York. The program developed out of the struggles of Black and Puerto Rican people South Bronx of New York to fight against the genocidal use of drugs (heroin, methadone, alcohol) and lack of quality healthcare in our communities.

The goals of Lincoln Detox were to provide the community with a healing, non-chemical solution to the detoxification of addicts (acupuncture and natural healing), train community people in the theory and use of acupuncture, and provide political education about the drug plague, who controls the drug empire and how to resist. The Program exposed the conspiracy of Government agencies, law enforcement agencies, organized crime, and drug companies in the waging of chemical warfare through drugs and methadone maintenance programs in out-communities.

Lincoln Detox’s Acupuncture Research Unit emerged as an Independent comprehensive people’s health-care program that relied on traditional and alternative health practices (acupuncture, massage, auriculotherapy, herbology, nutrition, exercise and vitamin therapy, and natural childbirth). The acupuncturists who developed this program received their training and Doctor of Acupuncture degrees from the Quebec Association of Acupuncture, under the teaching of Professor Oscar Wexu and Mario Wexu. They realized that there was a need to create a program that would provide training in acupuncture and other natural healing methods in order to offer these alternatives of treatment to our communities. The School at Acupuncture and Natural healing was formed in December 1977, and now has 30 students working towards degrees of Doctor of Acupuncture.

The two-year old school was developed to train lay acupuncturists for the purpose of creating sell-reliant urban “bare-foot doctors” and acupuncture clinics, accountable to the Third World communities.

The materialization of such as important political concept proved to be too great a threat to the New York City Medical Empire. The Acupuncture Clinic had always been the target of police attacks and counter-insurgency measures in the past, but the creation of the School exacerbated the medical attack on the clinic. This resulted in the relocation of two of our acupuncturists and the firing of a third, plus the ouster of the School from the Clinic.

Under such conditions the only solution was to break all lies with Lincoln Hospital and all those who supported their position, and to develop a truly autonomous people’s acupuncture clinic, school and association.

It is out of these struggles that B.A.A.N.A. was created, dedicated to providing quality, alternative healthcare education and professional training to Third World communities for their continuing survival and growth.

We are dedicated to fighting the genocide of all Third World people and 01 Black and Puerto Rican people in particular. This negrocide takes on many forms, from drug addiction, alcoholism, forced sterilizations, unnecessary surgery, poor quality foods, drugged childbirth and mechanical intervention in childbirth (fetal heart monitoring, induced labor, and unwarranted caesarean sections).

These practices are used on our people with total disregard for their true well-being. We know that Western procedures are often risky and dangerous and that western medicine is not the only way to approach disease. We want to educate our people in natural forms of medicine based totally on non-chemical methods of healing. These methods are extremely important for the survival of ourselves and our children in the face of the present conditions of sickness and disease and the genocidal practices of this Government against Third World People.

From the very beginning, the instructors of our school have maintained that throughout modern history people using acupuncture and natural healing modalities of treatment have been attacked by reactionary forces in an effort to destroy their struggles for self-reliance and control. We were also told of the inevitable attacks on our own school, particularly since this is the only institution in North America specifically controlled by and dedicated to the training of Black and Puerto Rican people in order to light the genocidal drug plague and the other forms of chemical warfare being waged in our communities.

Since November, 1978, these attacks have been intensified. Following a massive media smear campaign to discredit and undermine the Lincoln Detox People’s Program, 200 armed police forcibly closed the program that was successfully detoxifying drug addicts under the complete control of Black and Puerto Rican communities. As a result of this action, thousands of addicts were left without an alternative form of drug detoxification. In the face of these attacks, the Doctors of Acupuncture not only continued to train the students and serve the community’s health needs, but also worked to establish an independent institution.

We support:

– the human right of all people to choose and control their healthcare.

– the human right of all oppressed people, in particular Black and Puerto Rican people. to be trained in acupuncture and other forms of traditional medicine.

– the human right to wage a struggle to defeat chemical warfare by any ‘means necessary.

One or me means by which we plan to utilize our knowledge of traditional medicine is through educating the people about the chemical warfare used on Black, Puerto Rican and other Third World people. We feel that the possibilities for developing political awareness and an analysis of healthcare are systematically kept from Black and Puerto Rican people. We will organize ourselves to rally against the genocidal practices of this government. We must prepare people to arm themselves with the concepts of preventative traditional medicine in order to fight against the chemical-drug attack and to develop the skills necessary for survival in a society where health, especially the health of Third World people, is a very low priority.

We plan to develop adequate traditional health care facilities in our communities on a 24-hour, in-and-out patient basis. The majority of the medical facilities in our communities are severely lacking in quality healthcare, research and basic concern for the health of all people. We must provide a viable alternative to this situation.

We will provide effective alternatives to those “popular” drugs that people have been misled into using such as aspirin, Tylenol, Darvon, etc. that merely shut out pain rather than deal with the underlying causes of the disease in question.

We plan to continually research the epidemic illnesses such as cancer. sickle cell anemia and heart disease that have plagued modern society. We are hopeful that through serious research, practical application and intense struggle we can develop solutions to these epidemics.

In the future we will be communicating and sharing information with other acupuncturists, nutritionists, herbologists, etc. in order to expand acupuncture and natural healing on an international scale. We will unite with the broad spectrum of natural healers and health practitioners so as to establish our own health institutions and educational centers to deal with the important work that needs to be done.

We plan to constantly improve our understanding of traditional medicine in order to develop a unique, effective mode of treatment.

Our struggle against genocide will be strengthened by taking the issue to an international level. We are developing relations with the World Health Organization and International acupuncture associations to mobilize support and share information pertaining to health matters of international concern. We will fight the gross violations to human rights earned out against colonized people worldwide.

We urge those of you who support our goals and struggle to print this letter in publications to which you have access, circulate it in groups or organizations in which you work and keep in contact with us.
